General Terms and Conditions

General Terms and Conditions of the website and career platform of ZHAW School of Management and Law Career Services (Issued in 2025).

 

§ 1 Applicability

(1) These General Terms and Conditions (T&Cs) apply between ZHAW, represented by the School of Management and Law (SML), hereinafter referred to as ZHAW SML Career Services, and its business customers (“the customer”).

(2) General terms and conditions on the part of the customer that conflict with or deviate from these terms and conditions shall only become part of the contract provided ZHAW SML Career Services has expressly agreed to their validity in writing.

 

§ 2 Subject matter of the contract

(1) The ZHAW School of Management and Law offers products and services in the areas of campus recruitment, personnel marketing, and sponsoring via an online platform (www.career.sml.ch), in accordance with the current service description as published on the career platform.

(2) ZHAW SML Career Services offers customers the following services in particular:

a) The creation or publication of job advertisements, events, and company profiles.

b) Access to the CV database.

c) Participation in career events organized by ZHAW SML Career Services and the hosting of career-related events on campus.

 

§ 3 Conclusion and execution of the contract

The customer selects the required services from the ZHAW SML Career Services website, based on the range of services available at the time the order is placed. The respective contract is concluded when the ZHAW School of Management and Law confirms the order in writing or following online publication. The written form requirement is met by sending an email. A new contract is concluded for each range of services booked. The contract shall be governed by the General Terms and Conditions applicable at the time the contract is concluded. The customer remains unaffected by any changes to the terms and conditions (T&Cs) made by the ZHAW School of Management and Law during the contract period.

 

§ 4 Contract Period and early termination of the contract

The duration of the contract is based on the information in the service overview. The ZHAW School of Management and Law reserves the right not to provide a service or to remove advertisements that have already been published if the customer’s information or other content to be published violates legal requirements, official prohibitions, third-party rights, common decency or – in the opinion of the ZHAW School of Management and Law – the values of ZHAW SML Career Services (inadmissible content). The same applies if hyperlinks contain service elements that lead directly or indirectly to pages with illegal content. The customer’s obligation to pay remains unchanged, and the customer will be informed immediately of any such measure. The customer shall indemnify the ZHAW School of Management and Law upon first request against all claims asserted by third parties against ZHAW SML Career Services due to inadmissible content. The indemnification also includes the necessary legal costs.

 

§ 5 Disclaimer

The liability of ZHAW SML Career Services is limited to intent and gross negligence. Liability for consequential damage is excluded. The ZHAW School of Management and Law is not liable for the accuracy of the content on the ZHAW SML Career Services website. Since ZHAW SML Career Services content is made available on the public internet, the ZHAW School of Management and Law cannot guarantee the uninterrupted availability or accuracy of its services. The non-appearance of an advertisement or profile on the ZHAW SML Career Services website does not entitle the customer to claim damages. The ZHAW School of Management and Law is only obliged to publish the corrected or previously unpublished advertisement or profile at a later date.

 

§ 6 Advertisement and profile content

The customer bears sole responsibility for the content of its own output. The customer undertakes to publish only legally permissible content through the ZHAW School of Management and Law and, in particular, to refrain from publishing content that is racist, pornographic, or defamatory. The customer further confirms that the content is ethically, morally, and legally correct. The ZHAW School of Management and Law reserves the right not to publish content that does not meet these requirements or to delete it without incurring costs or paying compensation. By placing the order, the customer consents to the publication of its content on the ZHAW SML Career Services website. Companies may also place their own advertisements and profiles. 

 

§ 7 Access and use of the CV database

(1) The use of the CV database for any purpose other than the initiation of a service or employment relationship in relation to genuinely available job vacancies is not permitted. The customer certifies they will comply with all provisions of data protection and privacy law. The ZHAW School of Management and Law reserves the right to suspend the provision of services by blocking access or by any other suitable means if a customer breaches the contract, data protection, or personal rights. The customer’s obligation to pay is unaffected.

(2) Access to the CV database is granted to the customer by issuing an access code (user ID, password). The customer undertakes to keep this access code confidential and, in particular, not to share it with third parties. For each code issued, access to the CV database is only permitted to one natural person at a time, whose name must be communicated to the ZHAW School of Management and Law.

(3) Information provided by customers and users is provided exclusively by them. Accordingly, the ZHAW School of Management and Law cannot guarantee the completeness, correctness, accuracy, or availability of this information. Nor does the ZHAW School of Management and Law guarantee a particular number of responses or profiles within a given search criterion.

(4) Access to the CV database by companies and organizations that compete with the ZHAW School of Management and Law (hereinafter referred to as competitors) is not permitted. The ZHAW School of Management and Law reserves the right to suspend service provision at any time by blocking access or using any other suitable means if a customer is a competitor or if a customer shares information from the online platform or CV database with competitors. The customer’s obligation to pay is unaffected.

(5) Students must be enrolled at the ZHAW School of Management and Law to use the non-public area of the website/resume database.

(6) Customers and users agree that all essential communications relating to the use of the website/CV database will be sent by email, unless another form is required by law.

 

§ 8 Event notices and organization of career events at the ZHAW SML

A customer may publish event notices on the ZHAW SML Career Services platform for a fee.

The customer can request the early deletion of an event notice by ZHAW SML Career Services or delete the event notice directly through the online platform. Full payment must still be made in the event of early deletion. A pro rata temporis claim for reimbursement is therefore excluded.

 

§ 9 Events organized by ZHAW SML Career Services

The customer can participate in ZHAW SML Career Services events held on the ZHAW School of Management and Law campus or those organized by a third-party provider.

For ZHAW School of Management and Law on-campus events, the customer must observe the house rules.

For events organized by ZHAW SML Career Services through a third-party provider, the conditions of participation stipulated by the third-party will apply.

The distribution or posting of flyers or other printed materials by the customer on the ZHAW School of Management and Law campus or at the location where the service is provided is generally not permitted.

In exceptional cases, ZHAW SML Career Services may allow the placement of flyers or other printed materials. However, the customer must obtain prior written approval from ZHAW SML Career Services for this. The approval of ZHAW SML Career Services contains information regarding the time frame, scope, and location at which flyers and printed materials may be distributed or displayed.

 

§ 10 Cancellation of event participation by the customer

The customer will pay ZHAW SML Career Services the following fees for cancelling their participation in ZHAW SML Career Services events:

0-30 days before the event: 100% of the agreed fee.

31-60 days before the event: 80% of the agreed fee.

61-90 days before the event: 50% of the agreed fee.

91-120 days before the event: 25% of the agreed fee.

The customer is solely responsible for providing adequate insurance cover.

 

§ 11 Fees

Fees are based on the information published on the ZHAW SML Career Services website.

 

§ 12 Terms of payment

Invoices from the ZHAW School of Management and Law must be paid within 30 days of issue. Parties owing money to the ZHAW School of Management and Law are immediately in default 30 days after the unpaid invoice has been issued. The ZHAW School of Management and Law reserves the right to withdraw from the contract and discontinue its services after a 10-day grace period has elapsed.

 

§ 13 Place of jurisdiction and applicable law

Swiss law is applicable. The place of jurisdiction for all disputes is Winterthur.
